Barr Pharmaceuticals Issues Refunds to 340B Covered Entities
Following its acquisition of PLIVA and PLIVA subsidiary Odyssey Pharmaceuticals, Barr Pharmaceuticals discovered these companies had overstated the Average Manufacturer Price (AMP) reported to CMS from the second quarter of 2002 through the third quarter of 2006. Because these inaccurate AMPs resulted in overcharges to 340B entities that purchased products during the affected time period, Barr disclosed the 340B overcharges to the Office of Pharmacy Affairs and is undertaking an effort to refund 340B covered entity customers. Barr should have already sent refunds to eligible customers.
