SNHPA monitors, educates, and serves as an advocate on federal legislative and regulatory issues related to drug pricing and other pharmacy matters affecting safety-net providers. When Congress was creating the 340B program in 1992, SNHPA took the lead role in ensuring that hospitals were included in the program and the organization has been representing the interests of 340B hospitals ever since. The following are some of the legislative issues that SNHPA is focusing on:
2008 Advocacy Goals
Extend 340B program to DSH inpatient setting and include critical access hospitals in the 340B program.
Address the integrity of the 340B program by working to improve program oversight, administration, and compliance; recover 340B overpayments; make 340B prices available to covered entities.
Address proposed government guidelines that would significantly restrict the use of the 340B program by narrowing the definition of “patient” under the program.
Clarify Section 6002 of the Deficit Reduction Act of 2005 to avoid implementation by CMS mandating states to collect rebates on drugs administered by health professionals in hospital outpatient settings.
Make efforts to ensure that 340B participants benefit from proposed increase in Medicaid rebate discount and ensure that any changes to Medicaid rebate law do not adversely impact 340B program.
Improve the Medicare Pat D drug benefit to ensure 340B provider participation and allow contributions made by 340B pharmacies to count toward true out-of-pocket costs (TrOOP).
Address problems in accessing IVIG and other products at federally required 340B-discounted pricing.
