Important Developments in 340B Contract Pharmacy - 1/28/10

As you may know, the White House Office of Management and Budget (OMB) recently cleared the Health Resources and Services Administration (HRSA) guidelines authorizing covered entities to dispense 340B drugs through multiple contract pharmacy arrangements. Current guidance only permits one contract pharmacy arrangement per site, so it is likely that the new guidelines will be published soon. In addition, HRSA has relaxed its interpretation of the current contract pharmacy guidelines such that contract pharmacy arrangements may be more attractive to 340B hospitals. Contract pharmacies have historically been permitted to dispense 340B drugs only to those hospital patients who receive services from the hospital site to which the pharmacy is linked. Patients of any other hospital site have not been eligible to use the 340B contract pharmacy arrangement. A recent HRSA clarification, however, now recognizes the right of a contract pharmacy to use 340B to fill any outpatient prescription pertaining to a patient of the hospital, regardless of which hospital site has the relationship with the patient.
